Terms and Conditions

Welcome to philnjoe.com (hereinafter: "the Site"), operated by PJ Cosmetics Ltd., Company No. 516264876, 13 Frishman Street, Tel Aviv-Jaffa (hereinafter: "the Company" or "Phil & Joe").

These Terms and Conditions constitute a binding legal agreement between the Company and any user of the Site and/or purchaser of a product through it (hereinafter: "the User" or "the Customer"). Merely browsing the Site and/or making a purchase constitutes full and complete acceptance of these Terms and Conditions. Any user who does not agree to these Terms and Conditions is requested to refrain from using the Site.

These Terms are written in the masculine form for convenience only and are addressed equally to all genders.

1. General

1.1. The Site serves as an online store for the sale of hair care products, cosmetics and professional tools, including L'Oréal and Kérastase products and other professional brands.

1.2. The Company reserves the right to change these Terms and Conditions, product prices, promotions and sale terms at any time, at its sole discretion. The binding version is the one published on the Site at the time of purchase.

1.3. Product images are for illustration purposes only. There may be differences in color, packaging or texture between the display on the Site and the actual product, and this shall not constitute grounds for a claim.

1.4. The Company makes an effort to verify the accuracy of the information on the Site. Should a typographical or pricing error occur, such error shall not bind the Company, and the Company shall be entitled to cancel the order and refund the customer any amount paid.

2. Eligibility to Purchase

2.1. Any person aged 18 and over, holding a valid Israeli ID card or passport, with an email address and a valid credit card, may make a purchase.

2.2. A purchase by a minor under the age of 18 requires the consent of a parent or guardian. Making the purchase constitutes a declaration that the user is competent to do so.

3. The Order and Its Confirmation

3.1. An order shall be considered complete only after receipt of payment approval from the credit card company and receipt of an order confirmation notice from the Company.

3.2. The Company may, at its discretion, decline to approve an order - including in the event of a stock shortage, suspicion of misuse, incorrect details or refusal by the credit card company.

3.3. In the event of stock running out after order confirmation, the Company will notify the customer and refund the full amount paid, and the customer shall have no claim in this regard.

4. Prices and Payment

4.1. All prices on the Site are stated in Israeli shekels (₪) and include VAT as required by law.

4.2. Payment is made by credit card or any other online payment method presented on the Site. The Company does not store credit card details on its servers.

4.3. Shipping fees, where applicable, will be added to the order amount and presented to the customer before completion of payment.

5. Delivery and Shipping

5.1. Delivery of products is carried out by the courier company YSAGEV Courier and Transport, within 3 business days from the date of order confirmation.

5.2. Delivery times do not apply to exceptional localities not covered by the service, and may be extended during exceptional periods - including holidays, Fridays and holiday eves, and sale periods such as "Black Friday" and "Cyber Monday".

5.3. Shipping fees: Orders of 250 ₪ and above - free shipping. Orders under 250 ₪ - shipping fee of 35 ₪ including VAT.

5.4. If the customer chooses to leave the package without personal receipt (for example, outside the door) - this is the customer's sole responsibility, and the Company shall not be liable for loss of or damage to the package from the moment of its delivery to the address.

5.5. Business days are Sunday to Thursday, excluding Friday, Saturday, holiday eves and holidays.

6. Cancellation of Transaction, Returns and Refunds

6.1. Cancellation of a transaction shall be carried out in accordance with the Consumer Protection Law, 5741-1981 and the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010.

6.2. The customer may cancel a transaction within 14 days from the date of receipt of the product or from the date of receipt of the transaction details document, whichever is later.

6.3. Cancellation of the transaction and return of a product are conditional upon the product not having been damaged, not having been used, and being returned in its original, sealed packaging.

6.4. Due to the hygienic nature of cosmetic and care products, a product whose original packaging has been opened or damaged cannot be returned or exchanged, unless found to be defective or non-conforming.

6.5. The return of a product shall be at the customer's expense - by mail, or by direct delivery to the Phil & Joe salon, 13 Frishman Street, Tel Aviv-Jaffa.

6.6. In the case of cancellation of a transaction not due to a defect, the Company may charge a cancellation fee of 5% of the product price or 100 ₪, whichever is lower.

6.7. A refund will be made via the original payment method within 7 business days of approval of the cancellation and receipt of the returned product.

6.8. If the product is found to be defective or non-conforming to what was ordered - the Company shall bear the cost of return and refund the customer the full amount.

7. Liability and Products

7.1. The products sold on the Site are original and purchased from authorized suppliers.

7.2. The Company is not responsible for damage caused by improper use of the product, use contrary to the manufacturer's instructions, or personal sensitivity. It is recommended to perform a sensitivity test and review the usage instructions before use.

7.3. Nothing on the Site constitutes medical advice. In the event of a medical problem or sensitivity, please consult a physician.

7.4. L'Oréal and Kérastase products are imported and marketed in Israel by L'Oréal Israel Ltd. For any inquiry regarding a defective product, a non-conforming product or an allergic reaction to a product, you may contact L'Oréal Israel Ltd. customer service directly at 1-800-301-666. Nothing in the foregoing derogates from the customer's rights towards the Company under the law.

8. Intellectual Property

8.1. All intellectual property rights in the Site - including design, texts, images, logo and trademarks - are the property of the Company or of third parties who have granted it a license to use them.

8.2. It is prohibited to copy, reproduce, distribute or make commercial use of any content from the Site without the prior written consent of the Company.

9. Privacy

9.1. Use of the Site and the collection of information are subject to the Privacy Policy, which forms an integral part of these Terms and Conditions.

10. Limited Liability

10.1. The service on the Site is provided "AS IS". The Company does not guarantee the continuous availability of the Site and may suspend it for maintenance purposes.

10.2. The Company shall not be liable for any indirect, consequential or special damage caused to the user as a result of the use of the Site.

11. Accessibility

11.1. The Company works to make the Site accessible in accordance with the Equal Rights for Persons with Disabilities Law. Inquiries regarding accessibility may be directed to the contact details below.

12. Governing Law and Jurisdiction

12.1. These Terms and Conditions shall be governed solely by the laws of the State of Israel.

12.2. Exclusive jurisdiction over any dispute is vested in the competent courts of the Tel Aviv-Jaffa district.
